Njom Njoms sells pet and other products online. The use of any product bought from our website is at the purchaser’s risk. The purchaser / user indemnifies and holds Njom Njoms harmless against any loss, injury or damages which may be sustained as a result of using the products sold by Njom Njoms.

Please note that Business Days exclude weekends and public holidays.

Deliveries

  • Processing of orders takes place after payment has cleared into our account and may take up to 10 working days. The usual turn-around time for processing orders is to be ready for dispatch is 3 working days.
  • The online store cart calculator will determine your shipping fee based on your provided address and the volumetric size (greater of either weight or size) your cart as well as selection of delivery method. Fees quoted by the online store cart calculator are not final and may be adjusted after confirmation of your order, before your order is shipped.
  • Shipping fees are determined by the courier supplier and are subject to change at any time.
  • Pudo Locker-to-Locker delivery has limited availability, and large parcels may be delayed due to the large lockers being available for both dispatch and collection locations. Deliveries are made during business hours from Monday to Friday. We use economy courier: transit time for major hubs is 2-3 business days and outlying areas in 3-7 business day, once in the procession of the courier.
  • Courier to you door: facilitated by The Courier Guy. The client is responsible for any extra delivery costs if the client is unable to receive package on the day of delivery. The delivery address must be a physical address, and cannot be a post office box. Someone will need to be available at the address to receive the delivery. Deliveries are made during business hours from Monday to Friday. We use economy courier: transit time for major hubs is 2-3 business days and outlying areas in 3-7 business day, once in the procession of the courier.
  • The Njom Njoms workshop is in an outlying/rural area which can cause courier delays – the courier only comes through our area once a day and if the van is full, or if the van has already passed us before collections are loaded, then parcel collections may be delayed.
  • Limitations to accepting delivery or timeous collections (your availability) must be communicated to us before we dispatch your parcel. Once your parcel is with the courier, we cannot assist – please contact the courier directly with your waybill details.
  • Njom Njoms is not responsible for any loss or damage incurred by the courier. Due to the low value of our products, parcels are not insured.
  • Deliveries during peak times (eg. December/Christmas) can experience delays outside our control.

Cancellations

Orders can only be cancelled within 12 hours of placing the order, if the workshop has not yet started processing the order, with a full refund. Orders that have been processed in part or full, with shipping already arranged can be cancelled within 12 hours of placing the order, with a refund less the shipping fees. Orders that have been processed in full and deposited/collected by the courier will not be cancelled.

Njom Njoms reserves the right to refuse processing of payment for any order and/or to cancel any purchase, partially or completely, without prior notice given to you. Njom Njoms will be liable for reimbursing you the Rand value paid only if you have already paid for the cancelled order.

Refunds and Returns

STOCK SHORTAGES

Should a product you have ordered be:

  • Temporarily unavailable: we will notify you thereof as well as the anticipated delay in delivery and, unless you agree to wait for such period for delivery, or accept delivery of another product instead, or a credit we will issue a refund in respect of that product to you.
  • Permanently unavailable, we will notify you and, unless you agree to accept another product instead, or a credit we will issue a refund in respect of that product to you.

Should you have redeemed a voucher or coupon against a product that is temporarily unavailable and you do not agree to an extended delivery period, or to accept delivery of another product instead, or the product is permanently unavailable and you do not agree to accept another product instead, we will re-issue you with a replacement voucher to the same value, with the same voucher terms and conditions (no “cash” refunds will be done on vouchers/coupons/gift cards).

NON-DEFECTIVE PRODUCTS (your right to return)

Save for certain exceptional cases, you are entitled to return any purchase concluded on our store within 14 days of the product(s) being delivered. In order to obtain a refund, the product(s) being returned must be sent back to us in accordance with the return procedure set out below.

If the incorrect product is delivered to you by mistake (i.e. it is not the product you purchased), please do not remove the product from its original packaging or use the product at all. Please promptly contact us (orders@njomnjoms.co.za or WhatsApp: 079 241 6985) to notify us thereof, so that we can resolve the mistake by arranging to collect the incorrect product and deliver the correct product to you as quickly as possible.

Products or Items not eligible for Return or Refund:

  1. Food or snacks. Except for:
    • items of food that are damaged prior to receipt;
    • where the expiry date on the item precedes the delivery date
  2. Items explicitly marked as non-returnable
  3. Sale items or Gifts
  4. End of range, demo or “one-off” items
  5. Products that are made to order

DEFECTIVE PRODUCTS

General warranty:

If, within 6 months after delivery of a product to you:

You find that the product is defective/faulty, unsuitable for the purpose generally intended (or otherwise expressly indicated by us at time of purchase), or not legal or reasonably durable (based on the circumstances and product type) (“defective”); and – you arrange to return such product to us for inspection in accordance with the returns procedure, and the product is subsequently found to indeed be defective, you are entitled to either –

(a) be fully refunded, or (b) have the product repaired or replaced at our expense (the decision between repairing or replacing being that of Njom Njoms depending on availability and other relevant circumstances, and in this regard you acknowledge that Sale/ On Special products will usually only be able to be repaired).

If the product is found NOT to be defective, you will NOT be entitled to any repair, replacement or refund but will instead be liable for the costs incurred in having such product returned to Njom Njoms and then redelivered to you.

When is a product defective? Please note: the following are examples of things which will NOT be regarded as defects and will NOT entitle you to any repair, replacement or refund under the general warranty above: faults resulting from normal wear and tear; damage arising from incorrect usage of the product.

Supplier’s warranty:

Certain products may come with a supplier’s guarantee. If so, this will be stated in the product listing on the site. Clear details of these guarantees are given in their listings and no shopper may ask to be covered by a wider-ranging guarantee other than the one shown on such product listing.

PERCEIVED CHANGES IN PRODUCTS

We try to refain from overly processing our products and use locally sources raw ingredients. This means that from time to time, there may be inconsistencies in the appearance, composition, or taste of our foods. For example, raw ingredients harvested in Autum may give our rabbit pellets a different taste to raw ingredients harvested in Spring. Similarly, our pets may also have changes in their taste preferences. We regret we will not be able to accept returns or refunds due to these inconsistencies.

Similarly, many of our products are hand made and differences can be expected in size, appearance and weight.

EXCLUSIONS

You may not under any circumstances return the following:

Products that you or any other person has altered, repaired, incorporated or added to where such alteration, repair, incorporation or addition has not been authorised by Njom Njoms.

What is the delivery and returns policy?

If on receiving your order you are not absolutely happy with your purchase or we have delivered the wrong product or a faulty product or an item is missing, please contact us via email or WhatsApp with your order number and the reason for your return/refund request. Relevant pictures of the fault is helpful.

You must notify Njom Njoms within: 3 days for items missing from your order, or within 14 days for exchanges, returns and faulty products.

We will assist trouble shooting any potential issues. If the items meet the returns criteria, returning the items to our workshop will be permitted.

If you are wanting to return an item because it is unpalatable to your pet, doesn’t fit your pet or you have changed your mind and don’t want it any more, you will need to arrange to return the item, at your own cost, alternatively let us know if we should arrange a courier to collect the items from you, the return cost of shipping will be deducted from your refund amount. Returns will only be accepted if items are in their original packaging, original condition and in resellable condition. Used, soiled or worn items will be returned to you at your expense.

We reserve the right to charge a administration fee to the value of up to 45% of the returned products for returned orders should the returns process incur significant administration expenses whether the refund has been approved or not.

Approved refunds will be processed within 10 business days of the returned item having been inspected and approved by Njom Njoms, the money will be refunded back in the form of payment used for the original order (either EFT or Credit Card), unless specified that a store credit or a swop out is preferred.

PROCESSING OF CREDITS AND REFUNDS

Where your Njom Njoms account has been credited, you will be entitled to use such credit towards other purchases made by you on the site. Please note that if you’ve requested a refund as a credit on your profile- it is considered a final decision and cannot be changed to another credit option later.

If you bought a sale item and a return is permitted, the reduced price will be paid back to you and not the full price.

If you redeemed a voucher against your purchase, and wish to return the item(s) from that purchase, the rand value paid for the item(s) being returned will either be refunded or credited to your account. The value of the voucher that was redeemed will not be refunded to you, or credited to your account. Rather, Njom Njoms will re-issue you with a replacement voucher to the same value, with the same voucher terms and conditions.

Items bought with coupons, vouchers or credits will only be refunded by the way of a store coupon, voucher or credit – no cash refunds will be permitted.

FRAUD PREVENTION

Njoms Njoms reserves the right to refuse, in the interest of fraud prevention, processing any payment for any order, and/or to cancel any purchase partially or completely, with notice given to you. Njom Njoms will be responsible for returning funds for the cancelled portion of the order to you only if you have already paid such funds.

Njom Njoms undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. Njoms Njoms cannot be held responsible for security breaches occurring on the users electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.


Terms

Introduction

njomnjoms.co.za (“the site”) enables buyers to shop for items including pet food, accessories, toys, accessories, and pet health care products as well as pet themed items for humans (“the products”) online. All visitors to the site (“users” or “you”) will be able to see the products on offer, but only those who have registered for an account on njomsnjoms.co.za (“njomnjoms.co.za accountholders” or “you”) are able to buy.

Legally binding contract

All users and account holders, including those that buy from the site(“buyers”) are bound by these terms and conditions (“Ts&Cs”). By registering, or using the site at all, you recognise that you’ve read and accepted these terms and conditions.

With whom are you entering into a contract?

The site is owned and run by Njom Njom (PTY) LTD, registration number 2020/250133/07, a company incorporated in the Republic of South Africa (hereinafter referred to as “Njom Njoms”).

Products and availability

Please note that the stock of all items on offer is limited. Njom Njoms will make all reasonable attempts to ensure that special offers are brought to an end when stock runs out. If it happens that Njoms Njoms is unable to fulfil any order at the advertised price because stock is sold out, Njom Njoms will let you know and you’ll be entitled to a reimbursement for the rand value you have paid for such product. This is described in more detail in Njom Njoms’ Returns Policy

Buying products

The site allows you, the user, to place electronic orders (“order”) for one or more products on offer as long as such products are available and not sold out.

A purchasing contract (“sale”) between you and Njom Njoms only comes into effect once you have fully completed AND submitted the online order form for one or more products in your basket (“shopping cart”) AND your payment has been authorised by Njom Njoms (or has been received into Njom Njoms’ bank account). The above is dependent on the product being available.

Products on Njom Njoms cannot be reserved to be bought at a later stage, and placing an item in your basket without completing the order does not amount to a sale or an order. This means that Njom Njoms may remove any item from your basket before the sale actually takes place in the event of the product going out of stock.

Njom Njoms cannot be held responsible if an order has become unavailable by the time you try to complete a purchase at a later stage.

Fraud

Njom Njoms reserves the right, in the interest of preventing fraud, to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely.

Njom Njoms may request documentation to complete the necessary fraud checks and cancel any order where the necessary documentation is not provided in a timely manner.

In the event of a fraudulent purchase being placed on Njom Njoms, cardholders will be advised to initiate a chargeback via their bank in order to be refunded. Njom Njoms does not process refunds for orders suspected of fraud.

Njom Njoms does not provide order details relating to orders suspected of fraud.

What you pay for

The price of each product is given in the product information. In case of a sale or special offer, the discount price is shown.

  • Purchase price: The purchase price shown is determined by multiple factors. Please note purchase prices can change during the course of several seasons over which time, the product may be sold.
  • Delivery fees

Errors

Njom Njoms makes every reasonable attempt to display purchase prices and delivery costs accurately. If, however, the product is offered at an erroneous price (or an incorrect delivery cost is displayed), Njom Njoms will not be obliged to supply products at the incorrect price/delivery fee. Njom Njoms will only be liable to return payment already made by you in the case you choose to cancel the sale once you have been made aware of the correct price/delivery fee.

Paying by credit card

We accept payments made by Visa and MasterCard credit and debit cards, as well as EFT. When placing an order, the transaction details are presented to the bank for authorisation of the payment amount. If authorisation is not obtained, the order is cancelled. If authorisation is obtained, payment is usually immediate. You guarantee that you are fully authorised to use the credit card for payment of your order and that there are sufficient funds in this credit card account to cover the costs of any transactions you complete on Njom Njoms.

Paying by EFT

Our Electronic Funds Transfer (EFT) payment details are as follows:

Please Note: We can only process your order once funds have been transferred and reflecting on our bank account. This may take up to 48 hours- depending on who you bank with. If we haven’t received your proof of payment within 48 hours, your order will automatically be cancelled

Delivery completed

A delivery is considered complete as soon as the parcel is handed to an individual at your specified delivery address. This also applies when the package has been handed over by the courier, as indicated in the courier’s tracking system. It is your responsibility, as buyer, to ensure that you or the intended receiver of the gift (when applicable) inspect(s) the parcel on arrival and makes known any justifiable complaints within 48 hours. The receiver has the right to refuse the parcel if it appears to have been opened or if it has clearly been damaged. Such complaints and claims must be brought to the attention of Njom Njoms.

Complete records of each transaction between you and Njom Njoms are kept on the site for 12 months after a particular purchase or related transaction. After the12-month period the responsibility of keeping such record falls onto you.

Discount Vouchers and Coupons

Njom Njoms may release printed or digital discount vouchers/coupons [hereafter referred to as vouchers] from time to time. Such vouchers may be available through the web site and/or from third-party websites, in magazines and another media.

General

Vouchers can be used for discounts on the site only as long as the voucher is valid. Given expiry dates cannot be moved.

Promotional vouchers

Promotional vouchers are issued at Njom Njoms’ discretion. Users don’t have the right to promotional vouchers and can’t earn them. Promotional vouchers are issued with specific terms and conditions that regulate how and when they can be used. In general, unless otherwise specified on the voucher itself: a voucher is only valid for 30 days from date of issue. A voucher can only be used against a purchase on the site when the purchase meets the terms and conditions as specified on the voucher.

A voucher can only be used once and only one voucher can be used per shopping basket. Vouchers are not transferrable and cannot be exchanged for cash. The discount value of the voucher will be deducted from the total amount in your shopping cart. The remaining balance, if any, must be paid by you.

Promotion vouchers cannot:

  • Be used to buy other vouchers
  • Be exchanged for cash
  • Be transferred to anyone else
  • Be used after the expiry date which is 30 days from date of issue
  • Be used together with any other promotion, including against sales/ clearance items that have already been discounted or are on special offer

General Promotions

This offer is valid while stocks last or until date advertised on site.

Njom Njoms reserves the right to alter, amend or adjust the promotional guidelines.

Purchases made prior to the promotional period will not qualify.

Njom Njoms cannot be held liable for damaged promotional items after purchase.

Normal Njom Njoms Returns Policy applies to any goods purchased on promotion.

Discounted Prices on Njom Njoms

When Njom Njoms is running a discount promotion on specific products on the site – the discount price is shown on the category browsing page and the product page, as well as the Regular Retail Price.

When a discount price is shown on the product page, the discount price is the price you will pay when you add the product to your cart. The discounted price with discounted amount will be shown under View Cart and then again in Checkout as you complete your transaction

Gift Vouchers on Njom Njoms

Njom Njoms Gift Vouchers are not redeemable for cash and will not be replaced if lost, stolen, destroyed or used without permission. Gift Vouchers cannot be resold to or exchanged with a third party. You cannot use a Gift Voucher to purchase another Gift Voucher. Gift Vouchers can only be redeemed online through www.njomnjoms.co.za. Gift Vouchers are valid for 1 year from date of issue.

Security

Anyone downloading or trying to download malware or damaging coding on this site, or who tries to gain unauthorised access to any page on this site, will be prosecuted. ePETstore will claim civil damages from such person if Njom Njoms suffers any damage or loss.

You agree and guarantee that the username and password you use to log in is for your personal use only, and will not be passed on to any third party. You allow Njom Njoms to take all steps reasonably possible to ensure the integrity and security of the site and in the administrative office.

All credit card transactions on the site are protected by SSL (Secure SocketLayer) encryption and reinforced by various encryption processes with the aim of offering the most effective possible protection of any sensitive information. Njom Njoms has no access to any confidential information regarding your payment method. Only Njom Njoms banking partner will access confidential information (such as your credit card number, expiry date, CVV etc.) from time to time.

Indemnity

Njom Njoms is responsible for adhering to the Consumer Protection Act 68 of 2008(“CPA”) with the sale of any products from the site. Similarly, Njoms Njoms is responsible for adhering to articles 43(5) and 43(6) of the Electronic Communication and Transactions Act in terms of payment systems and security.
